The paper analyzes practices and discourses guiding business actions through the "anticipation" of the social contestability that can be generated by their activities. It discusses Alternative Dispute Resolution as a part of wider initiatives aiming to ensure the "public legitimacy" of companies which present themselves as practitioners of "corporate social responsibility" and "corporate environmentalism." Further, the research evaluates the influence of labor negotiation models to the consolidation of Environmental Dispute Resolution strategies, understood as one more path to ensure the continuity of capitalist economic development without questioning the structural processes that generates social and environmental conflicts.
